1. Subject of the online contract and its definition.
An online sales contract refers to a distance contract, i.e., a legal transaction concerning movable goods and/or services stipulated between a supplier and a client within the framework of a distance selling system organized by the supplier, who, for such a contract, uses the distance communication technology known as "Internet". All contracts, therefore, will be concluded directly through the access of the consumer client to the website corresponding to the address www.hamalfite.com where, by following the indicated procedures, they will conclude the contract for the purchase of the goods. "Client" refers to the natural person who purchases goods and services for purposes not directly related to any professional activity carried out. The following are the sales conditions that will remain effective until they are changed by the supplier. Any changes to the sales conditions will be effective from the moment they are published on the website www.hamalfite.com and will refer to sales made from that moment onwards.
2. Placing an Order.
2.1 To place an order, you must be of legal age and reachable by telephone.
2.2 You can place an order by filling out the order form available on the website www.hamalfite.com after registering and creating your personal account or by proceeding with quick Check-Out methods.
2.3 By submitting an order, you are making an offer to purchase the selected products based on these Terms and Conditions.
2.4 Although we commit to doing our best to supply the products indicated in the Order Confirmation, we may not be able to provide these products for reasons beyond our control. In this case, we will contact you to inform you and offer you alternative products that you may purchase. If you decide not to accept our proposals, we will cancel your order for the products we are unable to supply, and the amount related to your order will not be deducted from your reference account.
3. Sale prices and purchase methods.
All sale prices of products displayed and indicated on the website www.hamalfite.com, which constitute a retail offer, include VAT and any other taxes.
Prices are expressed individually for each product. The cost of transport may vary at the time of invoicing based on weight, volume, and number of packages; in case of delivery abroad, any additional costs due to taxes or duties provided by the current legislation in the destination State will be borne by you. The purchase contract is finalized by the accurate compilation and consent to purchase expressed through online acceptance.
You can pay for the ordered goods using the payment methods indicated online at the time of purchase.
4. Contract execution and delivery methods.
Hamalfité will deliver the selected and ordered products to you, using the methods referred to in the previous article, through trusted couriers and/or forwarders. In case of your absence at the time of delivery, a notice will be left, and you will have to personally contact the courier or forwarder as soon as possible to arrange the delivery methods, aware that all additional costs due to delayed delivery will be your sole responsibility. However, no liability can be attributed to the supplier for delayed or non-delivery due to force majeure or unforeseen circumstances.
5. Product availability.
You can purchase the products listed in the electronic catalog (available on the website www.hamalfite.com) and in the quantities available in stock. If an order exceeds the quantity existing in the warehouse, the IT system will accept the purchase only for the available products.
The product images are purely indicative and may therefore not perfectly represent the product characteristics, differing in colors, dimensions, or accessories. All products on the website www.hamalfite.com do not include boxes, packaging, and any other items for packaging the item unless expressly indicated in the description. Items that include boxes or other accessories have the specification in the item description or in the image.
In case of product unavailability, the customer will be notified within 24/48 working hours.
6. Our responsibilities.
Hamalfité assumes no responsibility for disruptions attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and other similar events that would prevent, in whole or in part, the execution of the contract within the agreed times. Hamalfité will not be liable to any party for damages, losses, and costs incurred as a result of the non-execution of the contract for the aforementioned causes. Similarly, Hamalfité is not responsible for any fraudulent and illicit use that may be made by third parties of credit cards, checks, and other means of payment, at the time of payment for purchased products. Hamalfité, in fact, at no time during the purchase procedure is able to know the buyer's credit card number which, by opening a protected connection, is transmitted directly to the Bank managing the service; similarly, Hamalfité is unable to check the correct and legitimate origin of the credit title delivered by the Customer upon receipt of the goods.
7. Buyer's obligations.
Once the online purchase procedure is completed, you undertake and oblige to print and keep these general conditions, which, moreover, you will have already viewed and accepted as an obligatory step in the purchase, as well as the specifications of the product being purchased, in order to fully satisfy the condition referred to in articles 3 and 4 of Legislative Decree no. 185/1999.
It is strictly forbidden to enter false and/or invented data in the registration procedure necessary to activate the process for the execution of this contract and the related further communications; the personal data and e-mail must exclusively be your real personal data and not those of third parties, or fictitious data. It is expressly forbidden to make double registrations corresponding to a single person or to enter data of third parties. Hamalfité reserves the right to legally pursue any violation and abuse, in the interest and for the protection of all consumers.
